Notice is hereby given under M.G.L., Chapter 41, Section 81-T (The Subdivision Control Law); M.G.L., Chapter 40A, Section 11 (The Zoning Act), and the Dartmouth Zoning Bylaws, Article 11 (Open Space Residential Development), of a PUBLIC HEARING to be held at 7:00 p.m. on Monday, November 16, 2020. The Town Office Building is closed to the public for meetings during the COVID-19 emergency per the Governor’s ban on public gatherings, and the Governor has issued an emergency order allowing municipal boards to temporarily conduct their business through videoconferencing platforms. This public hearing will have no physical location but rather will only be held remotely through the Zoom application and will be accessible for live interaction by the petitioners and the public using the Zoom.

The hearing concerns a application to amend the certificate of action for a previously approved Definitive (OSRD) Subdivision Plan entitled “OSRD Subdivision Plan of Bakerville Woods Dartmouth, Massachusetts“, as well as an application to amend the accompanying previously approved Special Permit for Open Space Residential Development. The approved Plan and Special Permit created a 5-lot subdivision with an open space parcel. The amendments to the certificate of action for the Plan and the Special Permit eliminate the conditions requiring public access to the open space parcel. The amendment to the Special Permit also updates the reference to the certificate of action for the Plan to reflect this change. The subject property is identified on Assessor’s Map 29 Lot 34.

To evaluate the release, a Phase I Initial Site Investigation was performed pursuant to 310 CMR 40.0480. The site has been classified as TIER II pursuant to 310 CMR 40.0500.
