Police chief files lawsuit against town over benefits

Police Chief Timothy Lee has filed a lawsuit against the Town of Dartmouth.

In a preliminary injunction filed with the Superior Court on Sept. 17, Lee argues that the town owes him work-related injury benefits. A hearing on the preliminary injunction is scheduled for Oct. 28.

The suit was filed against Town Administrator David Cressman and the four members of the Select Board.

Lee has been on sick leave since March 2015, citing stress as the reason for his absence. The Select Board voted later that month not grant him work-related injury benefits. According to court documents, this became the subject of numerous executive sessions.

Lee is no longer on payroll and has expended his sick leave and vacation time.

The preliminary injunction states that “the plaintiff is suffering irreparable harm because of the failure of the defendants to maintain the plaintiff on wage continuation benefits.”

On Sept. 30, Howard Greenspan, an attorney representing town officials, countered the preliminary injunction, requesting that the court dismiss the complaint.
