Fire District No. 3 works to fix election, committee seat legal issues

The Fire District No. 3 Prudential Committee election will go on as originally planned on April 30, as officials sort through a complicated legal mess that questioned exactly who is running it and if it is being done correctly.

At its April 17 meeting, the committee decided this year’s election will be run as closely to an “official ballot” election as possible. This means having the right personal such as a warden and police officer at the polling site. The only official requirement that cannot be met is the use of absentee ballots, as a deadline has already passed for those.

Ken Loranger, who is running against incumbent Robert Zina, raised concern over whether the election was legal, to which attorney John Markey and attorney Anthony Savastano said it is.

The confusion was a result of a recent discovery that the district’s election procedures were not up to official standards. For many years, the district used the same election procedures as other fire districts.

The committee is also sorting out an issue with its clerk and treasurer’s positions, after it was discovered the positions were not officially changed over from elected to appointed.

Members decided on three-year appointments for the clerk’s position, and the ability to award a contract, not award a contract, or decide on a contract on a case-by-case basis.

For the treasurer’s position the committee members voted 2-1 for an appointment of three years and for a contract. Committee member Mike Ricardo voted against the motion.

As for the clerk’s position, members voted 2-1 for a three-year position with the ability to award a contract on a case-by-case basis. Committee member Robert Zina voted against the motion.

The information will be sent to the state legislature, which must certify the positions are appointed and not elected.

The confusion over the clerk and treasurer positions, combined with outgoing clerk Joan Brennan believing she had resigned her position last month, left no one in charge of running the election.

Brennan, who is temporary serving as the treasurer is helping to run the election, although she asked at the committee’s previous meeting for assistance. She has received help from town clerk Lynn Medeiros in getting the proper people needed for the polling station.
